Terms of Service

1. Who we are

BitDuel is provided by Fintasys ("Fintasys", "we", "us"), based in Japan. You can contact us at support@fintasys.com. These Terms govern your use of the BitDuel mobile and web applications, and the related backend service (together, the "Service").

2. Acceptance

By creating an account or playing BitDuel, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 13 years old to use BitDuel (16 in European Economic Area countries that apply the higher GDPR age of digital consent). If you are below the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.

4. Your account

BitDuel signs you in anonymously by default; your data is bound to your device until you link a Google or Apple account. Linking a provider lets you preserve your profile across devices. You are responsible for the security of any linked identity provider account, and for any activity that takes place under your BitDuel account.

5. Acceptable use

You agree not to:

Cheat, automate gameplay, or use scripts, bots, modified clients, or any other technical means to gain an unfair advantage;
Exploit bugs or security vulnerabilities rather than reporting them to us;
Harass, threaten, impersonate, or harm other players, including through chat;
Submit content that is illegal, hateful, sexually explicit, or that infringes someone else's rights;
Attempt to disrupt the Service, reverse engineer the backend, or interfere with other players' experience;
Use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate these rules, without prior notice when necessary to protect the Service or other players.

6. User content

You retain ownership of content you submit to the Service (such as your display name, profile photo, and chat messages). You grant Fintasys a non-exclusive, royalty-free, worldwide license to host, store, transmit, and display that content as necessary to operate the Service. You represent that you have the right to grant this license for any content you submit.

7. Our intellectual property

BitDuel, including its name, logo, mini-games, code, art, sound, and copy, is owned by Fintasys or its licensors and is protected by copyright and other intellectual-property laws. These Terms do not grant you any right to use Fintasys trademarks except as required to identify the Service.

8. Termination

You may delete your account at any time from Settings → Delete account. Deletion removes your profile, friends list, chat history, and duel history from our active database. We may terminate or suspend your account if you violate these Terms; we will notify you where reasonably possible.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or the accuracy of every score, match outcome, or leaderboard ranking.

10. Limitation of liability

To the maximum extent permitted by law, Fintasys is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service is limited to JPY 10,000, or to the maximum amount permitted by your local consumer-protection law if it requires a higher floor. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to the Service or these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; material changes will be announced in-app before they take effect. Continued use after a change means you accept the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the Tokyo District Court (Tokyo Chiho Saibansho), Japan, except where mandatory consumer-protection law in your country of residence gives you the right to a different forum.
